Largest Civil Judgment of Its Kind in New Jersey Awarded to Victim of Non-Consensual Distribution of Intimate Images 

$8.7 Million Judgment in ‘Revenge Porn’ Lawsuit Against Philadelphia Man

CAMDEN, New Jersey – A New Jersey woman, J.G., has been awarded $8.7 million in a civil judgment against Tyler J. Jones, a Philadelphia resident who secretly accessed her intimate images without consent and then distributed and published those intimate images online. The award includes $326,080 in medical expenses, $350,000 in lost income, $3 million in pain and suffering and $5 million in punitive damages, which is believed to be the largest in the country under the recently revamped federal law.

“This case will serve as the foundation of hope for other victims seeking justice in their own cases of non-consensual distribution of intimate images, also known as ‘revenge porn,’” says Cali Madia Esq. “Cases like these are particularly cruel and are a form of gender-based violence and sexual assault that leverage technology. Our hope is that New Jersey will file criminal charges that match Philadelphia’s assessment of the depravity of this crime.”

Madia is referencing this week’s findings by Pennsylvania Attorney General Dave Sunday who, on Monday, July 7, announced charges against Jones in strikingly similar crimes against five Pennsylvania women. In that case, Jones was charged with felony counts of unlawful use of a computer and unlawful distribution, and misdemeanor invasion of privacy and unlawful dissemination. 

Jones failed to respond to J.G.’s lawsuit and was found liable by default. He later appeared at the damages hearing without legal representation and repeatedly invoked the Fifth Amendment when questioned.

Despite his prior conviction in a similar case in 2013 involving three other women, Jones is alleged to have continued to post intimate images of the plaintiff and others nearly every night, using anonymous forums and burner accounts to evade detection. The plaintiff spent months scouring pornographic message boards, including 4Chan, trying to remove the images before they could spread further. Subpoenas were issued to multiple tech companies in an effort to stop the ongoing harm and confirm Jones’ responsibility for the relentless postings. 

The complaint alleges that Jones, who often boasted about his actions online, referred to his violations as “glorious.”

The plaintiff never shared, sent or showed any private or intimate images with Jones, and the two were never involved in a romantic or intimate relationship. Jones, who was in a romantic relationship with J.G.’s friend, leveraged the trust between them to gain access to her phone within her own home and, thereby, her private images. The complaint alleges Jones then secretly shared the images to his phone and continued to post and spread those images online over the course of nearly two years. 

Repeat Offender

Our firm is honored to have played a small role in J.G.’s pursuit for justice. To say that Jones picked the wrong person to victimize is an understatement. First J.G. fought for the truth, next she fought for the others affected, and lastly, only after helping everyone else, she fought for herself. According to a Philadelphia Inquirer story published July 12, the Pennsylvania victims “largely credit the digital forensic digging the New Jersey woman did [J.G.] as the catalyst that brought their own cases to police attention. Three of the women knew Jones through friends or a spouse.”

We’re thrilled that Judge Kiel recognized the true harms felt by victims of image-based sexual abuse and are hopeful that courts around the country - criminal and civil - will take note. Even though no number will restore J.G.’s sense of privacy, peace of mind or mental health, this decision should send a clear message to those who are considering ignoring consent and common decency: there will be repercussions.
